1.2. “Company” or “My Sad Life”: My Sad Life, Registered Dealer No. 200775450, and any party acting on its behalf that manages the Website.

1.3. “User”: Any individual, corporation, or other legal entity, and anyone acting on their behalf, who browses the Website, registers on it, or makes use of its services, including any “Customer” making a purchase.

1.4. “Products”: Clothing items, accessories, and fashion products offered for sale on the Website.

1.5. “Terms”: These Website Terms of Use and all their parts, including the provisions of the Privacy Policy.

1.6. Purpose of the Website: The Website is intended to promote the Company’s brand, to display, market, and sell the Products to customers, and to enable the execution of online purchase transactions of the Products.

1.7. The Website is used to sell the Products directly. In order to complete a purchase, the User is required to provide identification details, a shipping address, and payment details, as specified in the Privacy Policy.

3.1. Orders: The Company reserves the right to refuse any order placed by a User, at its sole discretion. The Company may, at its sole discretion, limit or cancel quantities purchased per person, per household, or per order.

3.2. Prices and availability: Product prices on the Website may be changed at any time and without prior notice. The Company reserves the right to change or discontinue any service (or any part thereof) at any time and without prior notice.

3.3. Accuracy of account details: The User undertakes to provide current, complete, and accurate purchase and account information for all purchases made on the Website (including email address, credit card details, and expiration dates), so that the Company can complete transactions and contact the User if necessary.

3.4. Errors in price / stock: In the event of an error in price, product description, shipping fees, or product availability, the Company reserves the right to correct the error or cancel the order, even after it has been placed, subject to notice to the Customer.

4.1. All intellectual property rights in the Website, including copyrights, trademarks, designs, images, item designs, graphics, Website code, and any other content, are owned by My Sad Life.

4.2. No use may be made of any Website content (including copying, distributing, rewriting, selling, or any commercial use) without the Company’s prior written and explicit consent.

4.3. The User undertakes not to use the Company’s Products for any unlawful purpose, including violation of copyright laws or intellectual property rights of third parties.

5.1. The Website and the Products are offered on an “as is” basis. No representation or warranty, express or implied, is made regarding fitness for a particular purpose, quality, or accuracy.

5.2. Color display: The Company has made every effort to display the colors of the Products on the Website as accurately as possible. However, the Company cannot guarantee that the User’s computer screen or mobile device will display the colors accurately.

5.3. Limitation of liability: The Company shall not be liable for any direct or indirect damages caused to the User as a result of using the Website, relying on information, third-party breaches (such as hacking or malfunctions), system crashes, or other events beyond the Company’s control.

5.4. Liability cap: In any event, the Company’s liability for damage caused to the customer as a result of using a Product or the Website’s services shall be limited to the value of the Product purchased only.

6.1. The User agrees not to upload, submit, or publish on the Website any content that is illegal, threatening, racist, offensive, defamatory, pornographic, or that infringes the intellectual property or privacy rights of third parties.

6.2. The prohibited use of the Website’s content, as defined in the section “User Warranties and Responsibilities on the Website” (including copying, scraping, or unauthorized access), applies in full to these Terms as well.

8.1. These Terms and any dispute relating to them shall be governed exclusively by the laws of the State of Israel.

8.2. The exclusive jurisdiction for any legal proceedings relating to these Terms or the use of the Website shall be vested solely in the competent courts of the Tel Aviv–Jaffa District.
